Relevant legal bases
According to Article 13 GDPR, we inform you of the legal basis of our data processing. If the legal basis is not mentioned in the data information, the following applies: the legal basis for obtaining consent is Article 6, para. 1, lit. a and Article 7 GDPR, the legal basis for processing to fulfil our services and implement contractual measures and respond to enquiries is Article 6, para. 1, lit. b GDPR, the legal basis for processing to fulfil our legal obligations is Article 6, para. 1, lit. c GDPR, and the legal basis for processing to protect our legitimate interests is Article 6, para. 1, lit. f GDPR. If the vital interests of the data subject or another natural person require the processing of personal data, Article 6, para. 1, lit. d GDPR shall serve as the legal basis.
Safety measures
We take appropriate technical and organisational measures according to Article 32 GDPR, taking into account the state of the art, the costs of implementation, and the nature, scope, context, and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons in order to ensure a level of security appropriate to the risk.
The measures include, in particular, ensuring the confidentiality, integrity, and availability of data by controlling physical access to the data as well as the access to, entry into, disclosure of, assurance of the availability of, and segregation of the data. Furthermore, we have established procedures to ensure the exercise of data subject rights, the deletion of data, and responses to data compromise. Furthermore, we already take the protection of personal data into account during the development or selection of hardware, software, and procedures according to the principle of data protection through technology design as well as data protection-friendly default settings (Article 25 GDPR).
Automatic collection of data when visiting the website
When you visit the website, each server automatically saves the accesses to Internet pages. Temporary storage of the IP address by the system is necessary in order to enable delivery of the website to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session. Our web server temporarily records the following for the purpose of system security:
- the IP address
- the date and time of the request
- the time zone difference to Greenwich Mean Time (GMT)
- the content of the request (specific page)
- the access status/HTTP status code
- the amount of data transferred in each case
- the website from which the request comes
- the requesting browser
- the operating system and its interface
- the language and version of the browser software
Under no circumstances do we use the data collected for the purpose of drawing conclusions about you as a visitor to our website. Rather, this information is required to: (1) correctly deliver the contents of our website, (2) optimise the contents of our website and the advertising for it, (3) ensure the long-term functionality of our information technology systems and the technology of our website, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack.
These anonymously collected data and information can therefore be analysed by us both statistically and with the aim of increasing data protection and data security in our company in order to ultimately ensure an optimal level of protection for the personal data processed by us. The anonymous data of the server log files are stored separately from all personal data provided by you.
The legal basis for the data processing is Article 6, para. 1, lit. f GDPR.
Hosting
Our website is operated on server systems of Strato AG, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany (www.strato.de). The company is certified according to DIN ISO 9001 and DIN ISO 27001. Our hosting services provide the following: Infrastructure and platform services, computing capacity, storage space and database services, security services, and technical maintenance services that we use for the purpose of operating this on-line service.
In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta, and communication data of customers, interested parties, and visitors to this on-line offer on the basis of our legitimate interests in an efficient and secure provision of this on-line offer in accordance with Article 6, para. 1, lit. f GDPR in conjunction with Article 28 GDPR (conclusion of order processing contract).
SSL encryption
In order to protect the security of your data during transmission, we use state-of-the-art encryption procedures (e.g. SSL) via HTTPS.
You can tell whether an individual page of our website is transmitted in encrypted form by the display of the key or lock symbol in the status bar of your browser.
Deletion or blocking of the data
We adhere to the principles of data avoidance and data minimisation. We therefore store your personal data only for as long as is necessary to fulfil the purposes stated here or for the various storage periods stipulated by law. After the respective purpose has ceased to exist or these periods have expired, the corresponding data will be routinely blocked or deleted according to the statutory provisions.
Disclosure of data
We disclose or transfer data to third parties (e.g. payment service providers) only when legally permitted – for example, to fulfil contracts in accordance with Article 6, para. 1, lit. b GDPR, with your consent, because of legal obligations, or based on our legitimate interests (e.g. when using agents or web hosts).
If we commission third parties with the processing of data on the basis of an “order processing contract”, this is done on the basis of Article 28 GDPR.
If we process data in a third country (i.e. outside the European Union (EU), the European Economic Area (EEA) or the Swiss Confederation) or if this is done in the context of the use of third-party services or disclosure or transfer of data to other persons or companies, this will take place only if it is done to fulfil our (pre)contractual obligations, on the basis of your consent, on the basis of a legal obligation, or on the basis of our legitimate interests. Subject to express consent or contractually required transfer, we process or have the data processed only in third countries with a recognised level of data protection or on the basis of special guarantees (e.g. contractual obligation through standard protection clauses of the EU Commission, the existence of certifications, or binding internal data protection regulations (Article 44 to 49 GDPR)).
Cookies
Cookies are used on this website to enable certain functions. “Cookies” are small text files that your browser can store on your device. These text files contain a characteristic character string that uniquely identifies the browser when you return to this website. Cookies can be set both by the website itself as well as by external web services. Cookie technology also makes it possible to recognise individual visitors by means of pseudonyms (e.g. an individual or random ID).
Insofar as the cookies are processed on the basis of consent in accordance with Article 6, para. 1, lit. a GDPR, this consent also applies as consent within the meaning of Section 25, para. 1 Telecommunications–Telemedia Data Protection Act for the setting of the cookie on the user’s terminal device. Insofar as another legal basis is stated according to the GDPR (e.g. to fulfil a contract or to fulfil legal obligations), the storage or setting takes place on the basis of an exception in accordance with Section 25, para. 2 TTDSG. This is the case “if the sole purpose of storing information in the end user’s terminal equipment or the sole purpose of accessing information already stored in the end user’s terminal equipment is to carry out the transmission of a communication over a public telecommunications network” or “if the storage of information in the end user’s terminal equipment or access to information already stored in the end user’s terminal equipment is strictly necessary to enable the provider of a telemedia service to provide a telemedia service explicitly requested by the user”.
The cookies are used on this website to maintain the full functionality of the website, to improve user-friendliness, or to pursue the purpose stated with your consent.
Our cookies are stored until they are deleted in your browser or, if it is a session cookie, until the session has expired.
You can set your browser according to your wishes so that the setting of cookies is generally prevented. You can decide on a case-by-case basis whether to accept cookies or to accept them by default. Cookies can be used for various purposes (e.g. to recognise that your access device is already connected to our website (permanent cookies) or to save recently viewed offers (session cookies)). If you have expressly given us permission to process your personal data, you can revoke this consent at any time. Please note that this does not affect the legality of processing based on consent before it is revoked.
Collection of data that you have transmitted yourself
If you contact us by email, telephone or fax, the data you provide in this way (e.g. your email address, telephone number or fax number, your name, and any other personal data you provide) will be stored by us in order to answer your questions. We delete the data once storage is no longer necessary or restrict processing provided no legal retention periods apply. The legal basis for the processing of data transmitted in the course of a conversation is Article 6, para. 1, lit. f GDPR. If the contact is aimed at the conclusion of a contract with us, Article 6, para. 1, lit. b GDPR is the legal basis for the processing of the data.
If you contact us via the contact form on this website, at least your name and email address must be provided. Further information can be provided voluntarily. Data processing for the purpose of contacting us is carried out in accordance with Article 6, para. 1, lit. f GDPR on the basis of our legitimate interest or, if your enquiry is aimed at taking on a mandate or concerns a mandate that has already been taken on, on the basis of Article 6, para. 2, lit. b GDPR. The personal data collected by us for the use of the contact form will be deleted after completion of the enquiry or a resulting order provided that no other legal or contractual requirements require the further storage of your data.
For the sake of good order, please note that data transmission on the Internet (e.g. when communicating by email) can generally have security gaps; complete protection of data against access by third parties is not possible.
Your rights
You have the right to access, correct, or erase your personal data and restrict its processing as legally entitled.
Finally, you have the right to object to the processing of your personal data within the framework of the legal requirements. Because we process data as part of our website based on a careful weighing of interests, we would carefully examine an objection and reserve the right to make enquiries about the “special situation” within the meaning of Article 21, para. 1 GDPR.
Right to appeal
You have the right to complain to a data protection supervisory authority about the processing of personal data by us: The supervisory authority in which our company has its registered office is responsible:
Berlin Data Protection Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59-61, 10555 Berlin, Germany.
Changes to our privacy policy
We reserve the right to periodically amend this privacy policy (Last revised August 2020) so that it always complies with current legal requirements or so that we can implement changes to our services in the data protection declaration (e.g. when introducing new services). Your renewed visit will then be subject to the new data protection information.
